All content, courses, coaching, community discussions, programme materials and other information provided through the Platform are for general informational and educational purposes only. Nothing on the Platform constitutes, and should not be construed as:
Always seek the advice of a qualified professional, such as a licensed financial adviser, solicitor, accountant, doctor or psychologist, before making any decisions based on information obtained through the Platform.
Visionary Network makes no representations, warranties or guarantees of any kind, express or implied, regarding the results, outcomes, income, revenue, business growth, personal development, career advancement or any other results that you may achieve through use of the Platform, its courses, coaching services or community.
Individual results vary significantly based on factors entirely outside our control, including but not limited to: your level of effort and commitment, your prior knowledge and experience, your market conditions, your personal and professional circumstances, the time you dedicate to applying the material, and external economic conditions. Past results of other members or case studies presented on the Platform are not indicative of future results and are not a guarantee of what you will achieve.
Any testimonials, success stories, income figures or results shared by members or on the Platform represent individual exceptional results and should not be considered average, typical or expected outcomes. Your results will likely differ.
The Platform is provided on an "as is" and "as available" basis. We do not warrant that the Platform will be uninterrupted, error-free, secure or free from viruses or other harmful components. We reserve the right to perform maintenance, upgrades or modifications that may result in temporary interruption of service without liability.
To the maximum extent permitted by applicable law, Visionary Network expressly disclaims all warranties, whether express, implied, statutory or otherwise, including without limitation implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. Nothing in these Terms shall exclude or limit warranties that cannot be legally excluded under mandatory applicable law.
To the fullest extent permitted by applicable law, Visionary Network, its operator, employees, contractors, partners and affiliates shall not be liable to you or any third party for:
Where liability cannot be fully excluded under mandatory applicable law (including but not limited to EU consumer protection rules), our total aggregate liability to you shall in no event exceed the total amount you paid to Visionary Network in the twelve (12) months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be limited or excluded under applicable mandatory law.
You agree to defend, indemnify and hold harmless Visionary Network, its operator, directors, employees, contractors, agents, partners, successors and assigns from and against any claims, liabilities, damages, judgements, awards, losses, costs, expenses and fees (including reasonable legal fees) arising out of or relating to:
We reserve the right to suspend, restrict or permanently terminate your access to the Platform at any time, with or without notice, if we determine, at our sole discretion, that you have violated these Terms, our Terms of Use, or applicable law; that your conduct is harmful to other users or to the Platform; or for any other reason we deem sufficient.
Upon termination: your licence to use the Platform immediately ceases; you lose access to all content and community features; no refund will be issued for any unused portion of a prepaid period where termination is due to your breach. Where termination is for reasons other than your breach, we will provide a pro-rated refund of any prepaid amounts for the remaining unused period, to the extent required by applicable law.
You may cancel your subscription or close your account at any time by contacting us at info@visionarynetwork.pro. Cancellation will take effect at the end of the current billing period. You will retain access to the Platform until that date.
The Platform integrates with and may contain links to third-party services, including Discord, payment processors, social media platforms, and content from partner organisations. These third-party services are governed by their own terms and privacy policies.
We are not responsible for the availability, accuracy, content, products or services of third-party platforms. Inclusion of a link or integration does not imply endorsement. You access third-party services at your own risk.
Our community primarily operates through Discord. Your use of Discord is subject to Discord's own Terms of Service and Community Guidelines. We are not liable for Discord's actions, outages, policy changes or enforcement decisions.
Visionary Network operates an affiliate programme that allows approved participants to earn commissions by referring new paying members. Participation in the affiliate programme is subject to separate Affiliate Programme Terms communicated upon acceptance into the programme.
We reserve the right to modify commission rates, payment terms and eligibility criteria at any time with notice to active affiliates. We reserve the right to terminate any affiliate's participation if we determine fraudulent, misleading or non-compliant promotional activity has occurred. Commissions are forfeited upon termination for cause.
Affiliates must clearly disclose their affiliate relationship when promoting Visionary Network, in accordance with applicable advertising and consumer protection law including the German Act Against Unfair Competition (UWG) and applicable FTC guidelines for international audiences.
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. Mandatory consumer protection provisions of the EU Member State in which you are habitually resident shall apply to the extent they afford you greater protection than German law.
For disputes not resolved through negotiation, the courts of Germany shall have exclusive jurisdiction, subject to any mandatory provisions of applicable consumer protection law that may grant you the right to bring proceedings in your country of residence.
If you are a consumer residing in the EU, you may submit a dispute to the EU Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr. We are not obliged to and do not voluntarily participate in dispute resolution before a consumer arbitration board, but we are committed to resolving complaints directly and in good faith.
Before initiating any formal proceedings, we encourage you to contact us at info@visionarynetwork.pro to attempt to resolve the dispute informally.
We reserve the right to modify these Terms at any time. We will notify registered users of material changes by email or through the Platform at least 14 days before the changes take effect. Your continued use of the Platform after the effective date of revised Terms constitutes your acceptance of those changes.
If you do not agree to the revised Terms, you must cease using the Platform and may cancel your account before the changes take effect.
Visionary Network shall not be liable for any failure or delay in performing its obligations where such failure or delay results from any cause beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics or epidemics; war, armed conflict, terrorism, civil unrest or government sanctions; cyberattacks, DDoS attacks or malicious interference with our infrastructure; failure of third-party providers including hosting, payment processors, Discord or internet backbone operators; power or internet outages; or government orders or regulatory changes that materially affect service delivery. Obligations shall be suspended for the duration of the event. We will notify users and resume normal service as soon as practicable. This clause applies regardless of whether German law, English law, or another governing law applies, including under BGB §§ 275 and 313 (German statutory impossibility and changed circumstances), the French doctrine of force majeure, and the ICC Force Majeure Clause 2020.
Visionary Network operates as a hosting service provider within the meaning of the EU Digital Services Act (DSA, Regulation (EU) 2022/2065, fully applicable since 17 February 2024) and the German Digital Services Act (DDG, in force since 14 May 2024, replacing the TMG). Under DDG § 10 and Art. 6 DSA, we are not liable for information stored at user direction provided that: (a) we do not have actual knowledge of its illegal nature; and (b) upon obtaining such knowledge or a competent authority's order, we act expeditiously to remove or disable access. Nothing in these Terms creates an obligation to actively monitor user content (DDG § 7 Abs. 2; Art. 8 DSA).
To the extent that US law is applicable (including for US-based users), Visionary Network is an "interactive computer service" within the meaning of 47 U.S.C. § 230(f)(2). We shall not be treated as the publisher or speaker of any information provided by another "information content provider" (§ 230(c)(1)). Our good-faith moderation actions, including restricting, removing or declining to remove content, shall not give rise to liability under § 230(c)(2).
Equivalent intermediary liability protections in other jurisdictions are recognised and relied upon, including Australia's Online Safety Act 2021 safe harbour for hosting services; Canada's equivalent intermediary protections; and Singapore's Electronic Transactions Act provisions. Users acknowledge that Visionary Network is not the originator of third-party content and that applicable national intermediary protections apply to our operations.
In accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512), Visionary Network has designated an agent to receive notifications of alleged copyright infringement.
Knowingly submitting a false DMCA notice may expose you to liability under 17 U.S.C. § 512(f), including costs and attorney's fees.
If you believe your content was removed in error, file a counter-notice containing: your signature; identification of the removed material and its prior location; a statement under penalty of perjury that removal was a mistake or misidentification; and your name, address, telephone number and consent to jurisdiction. We will forward the counter-notice and may reinstate the content within 10–14 business days absent a court action by the complainant.
Consistent with 17 U.S.C. § 512(i)(1)(A), Visionary Network maintains and enforces a repeat infringer policy. Accounts subject to multiple substantiated takedown notices will be suspended or permanently terminated, regardless of membership status or tenure.
These Terms are formed and enforceable electronically. By clicking "accept", creating an account, or using the Platform, you form a legally binding contract under the following frameworks:
You waive any right to object to enforcement of these Terms on the grounds that they were formed electronically or that no physical signature was obtained.
For all other users, including business users, affiliates, partners, and users outside the EU/UK, any dispute, controversy or claim arising out of or relating to these Terms, or their breach, termination or invalidity, shall be finally settled by binding arbitration under the ICC Rules (International Chamber of Commerce). Seat: Frankfurt am Main, Germany. Language: English. Arbitrators: one (unless ICC determines three are warranted). Governing law of merits: German substantive law. Awards are final and enforceable under the 1958 New York Convention (171 signatory states). All arbitration proceedings shall be confidential. Either party may seek interim injunctive relief from a court pending arbitration.
To the fullest extent permitted by applicable law, all users who are not EU/UK consumers waive the right to bring or participate in any class action, collective action, private attorney general action or other consolidated proceeding. All claims must be brought individually. This waiver is enforceable under the US Federal Arbitration Act (AT&T Mobility v. Concepcion; Epic Systems v. Lewis), Australia's Competition and Consumer Act 2010, Canadian arbitration law, Singapore's Arbitration Act, and equivalent frameworks in applicable jurisdictions. Where disputes proceed in court, all parties waive any right to a jury trial to the maximum extent permitted by law.
The Platform is operated from Germany under German and EU law. Users outside Germany are responsible for compliance with local law. Jurisdiction-specific provisions:
UK users are subject to the UK GDPR (Data Protection Act 2018) and UK Consumer Rights Act 2015 where applicable. The ICO (Information Commissioner's Office) is the UK supervisory authority. References to "GDPR" in these Terms include UK GDPR for UK users.
US law is not the primary governing law, but where US law mandatorily applies (DMCA, CAN-SPAM Act, applicable state consumer protection laws) those provisions apply as set out in these Terms and our Terms of Use. California residents additionally benefit from CCPA/CPRA rights detailed in our Privacy Policy.
Canadian users are subject to PIPEDA and, for Quebec residents, Law 25 (Act Respecting the Protection of Personal Information in the Private Sector). Use of the Platform constitutes valid PIPEDA consent to data processing as described in our Privacy Policy.
Australian Consumer Law (Competition and Consumer Act 2010, Schedule 2) non-excludable rights and guarantees apply to Australian consumers to the extent required. Where permissible, our liability for breach of such guarantees is limited to re-supply of the service or payment of re-supply costs.
Brazilian users are subject to the LGPD (Law 13.709/2018). Personal data of Brazilian users is processed in accordance with both our GDPR framework and the LGPD. Brazilian Data Subjects have equivalent rights as set out in our Privacy Policy.
Indian users are subject to the Digital Personal Data Protection Act 2023 (DPDP Act). We act as a Data Fiduciary under the DPDP Act and implement appropriate safeguards for Indian Data Principals. Rights of Indian users regarding their personal data are set out in our Privacy Policy.
If any provision is held invalid or unenforceable, it shall be severed and the remaining provisions continue in full force. The parties shall use reasonable efforts to agree a valid replacement reflecting the original commercial intent.
These Terms, together with our Privacy Policy and Terms of Use, constitute the entire agreement between you and Visionary Network regarding the Platform and supersede all prior agreements, negotiations and representations on the same subject matter.
Failure to enforce any provision on any occasion is not a waiver of the right to enforce it thereafter. Any waiver must be in writing and signed by an authorised Visionary Network representative.
You may not assign your rights or obligations without our prior written consent. Any purported assignment without consent is void. Visionary Network may assign freely, including in connection with a merger, acquisition or asset sale, without notice or consent.
Notices to you may be by email or Platform posting. Notices to us must be in writing to the address in Section 17 or to info@visionarynetwork.pro and are effective on receipt.
The following sections survive termination of these Terms: Sections 7 (Intellectual Property), 9 (Disclaimer), 10 (Limitation of Liability), 11 (Indemnification), 15 (Governing Law), 20 (DMCA), 22 (Arbitration), 23 (Class Action Waiver) and 25 (General Provisions).
These Terms confer no rights or remedies on any person other than you and Visionary Network. There are no third-party beneficiaries.
These Terms are written in English and shall be interpreted in English. Any translation is for convenience only; the English text governs in case of inconsistency.
The Platform may be subject to export control regulations of Germany, the EU (Council Regulation (EC) No 428/2009 and successors), the United States (EAR, 15 C.F.R. Parts 730–774; OFAC regulations, 31 C.F.R. Parts 500–598) and applicable UN Security Council resolutions. You represent and warrant that: (a) you are not located in or a national of a country subject to a comprehensive EU, US or UN trade embargo; (b) you are not listed on the OFAC SDN List, the EU Consolidated Sanctions List, or any applicable UN sanctions list; and (c) you will not use the Platform in violation of any applicable export control or sanctions law. Violation of this section may result in immediate account termination and may be reported to relevant authorities.
